The number of endorsements for the DEFIANCE Act has risen to 86, including recent endorsements from Snap Inc (Snapchat), the Software & Information Industry Association (SIIA), the Center for AI Policy, and the Tech Oversight Project. The DEFIANCE Act is a bipartisan bill to address and prevent non-consensual deepfake pornography by empowering victims to seek justice. Once codified into law, the act will create a civil right of action to legally challenge the creation, distribution, and solicitation of deepfake pornography made without the consent of the person depicted.
In July, the bill passed the Senate unanimously. It’s currently pending in the House of Representatives.
On December 2, the SVPA was joined by 16 organizations in an open letter organized by Encode Justice, urging the House to pass the DEFIANCE Act. The letter detailed the dangers of neglecting to regulate intimate deepfake content and the measures the DEFIANCE Act would take to prevent its nonconsensual distribution.
On December 5, the SVPA was joined by 26 organizations in a second letter. This letter, led by Americans for Responsible Innovation (ARI), implores Congress to pass both the DEFIANCE Act and the TAKE IT DOWN Act, which requires digital platforms to establish policies and processes for removing nonconsensual intimate imagery and makes it illegal for users to post this content.
